We hereby agree that Pinecrest Swim Team, its members, coaches, or officers of the Pinecrest Swim Club shall not be liable for any injury or loss which my child sustain while participating in activities of any kind, whether sponsored by or under supervision of the Pinecrest Swim Team, or Pinecrest Swim Club, and we agree to indemnify and to hold harmless Pinecrest Swim Team, and Pinecrest Swim Club, its member, officers, or designates of any kind, from any claim whatsoever.

Coronavirus/COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal and state authorities recommend social distancing as a means to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability and death. Accessing Pinecrest Swim Club could increase the risk of contracting COVID-19. Pinecrest in no way warrants that COVID-19 infection will not occur through accessing our facility. 

I acknowledge, understand and agree that accessing Pinecrest comes with risks. I will not hold Pinecrest responsible if I contract COVID-19. I agree to comply to the guidelines that have been established by the Ohio Department of Health, Greene County Public Health Department and Pinecrest Swim Club to prevent the spread of the virus. These guidelines are posted.

If swimmer(s) is NOT or Will Not be a 2024 Season dues paying member of the Pinecrest Swim Club. Dues paying members includes full stock member, paying stock over 3 years members or trial member. Then swimmer(s) can be a Swim Team Only Member. Each swimmer will incur an additional $75 fee as a result of Swim Team Only Membership. This swim team only membership includes access to Pinecrest Swim Club during the hours of 8:30am - 10:45am Monday - Friday, Home Swim Meets, and other Swim Team Events. The swimmer does have guest privileges up to 7 times during season to Pinecrest Swim Club during regular operating hours (Guest Fee $5). The Swim Team Only Membership fee will be given to the Pinecreast Swim Club by the Swim Team. 

In consideration of the acceptance of this application, we, the undersigned participant and parent or guardian, intending to be legally bound, do hereby for ourselves, our heirs, executors, and administrators, waive, release, and forever discharge any and all rights and claims for damages which we or either or us may hereafter have against the Greater Dayton Swimming Association, Member Pools, and/or their respective officers, agents, representatives, successors, and/or assigns, for any and all injuries or damages which may be suffered by me in connection with, or entry in, and/or arising out of my traveling to or participating in, and returning from meets.

1. Participation in GDSA events or activities by my child and myself involves the possible exposure to and illness from infectious and/or communicable diseases including, but not limited to, COVID-19, MRSA, influenza, and other infectious or communicable diseases. While adherence to particular rules and requirements may reduce the risk of possible exposure, the risk of serious illness and death remains; and

2. On behalf of my child and myself, I knowingly and freely ASSUME ALL SUCH RISKS, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation; and

3. On behalf of my child and myself, I agree to comply with all rules, regulations or conditions established by GDSA and the State of Ohio for participation in such events or activities. If, however, I observe any violation of the rules, regulation or conditions established by GDSA or State of Ohio during my presence or participation, I shall remove myself from participation and immediately bring such matter to the attention of the GDSA; and

4. On behalf of my child and myself, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS GDSA, its board members, officials, agents, employees, Members, Leagues and Associations, clubs, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event or activity in which I participate (“RELEASEES”), from and against any and all claims of whatever type or kind including any illness, disability, death, or other loss or damage to person or property, whether arising from the negligence of Releasees or otherwise to the fullest extent permitted by law. Further, I expressly agree that this release is intended to be as broad and inclusive as permitted by the laws of the State of Ohio or any other state in which my/our child may participate in any event or activity described herein, and that if any portion of this release is determined to be invalid, it is agreed that the remaining provisions of this release shall continue in full force and effect. Finally, I further state that I have fully and carefully read the above release, understand the contents of the same and sign this release voluntarily and as my own free act and deed.

By registering as members of Greater Dayton Swim Association (GDSA), all members understand and agree that GDSA may use photographs of members for appropriate purposes, including but not limited to: still photography, videotape, electronic and print publications, the league website, and league social media in order to promote, advertise, and/or celebrate the league.
